Florida prisons hold 382 people who have been sentenced to die.

Ayala cited time, resources and cost to taxpayers in her decision to not pursue the death penalty for Loyd or any other accused criminal.

Gov Scott immediately asked Ms Ayala to recuse herself, but she refused.

Orange-Osceola County State Attorney Aramis Ayala said Thursday that after conducting a review of death penalty cases that public safety is not improved for citizens or police and that they are costly and can take years to resolve.

In a statement, Scott said he was "outraged and sickened" by the two murders. "She has made it clear that she will not fight for justice and that is why I am using my executive authority to immediately reassign the case to State Attorney Brad King", Scott said in a statement.

Florida Gov. Rick Scott is also against Ayala's decision.

Florida's death penalty is deeply flawed.

She said Florida spends $51 million more per year holding inmates on death row than it would holding them for life without parole, and added that the average death row inmate waits 12 years between sentencing and execution. "A new statute was enacted this past Tuesday morning".

For much of past year, executions in Florida were on hold. Questions over Florida's death penalty law have cast doubt over the sentence. The law now requires that jurors recommen capital punishment unanimously. But several groups, including Amnesty International USA and the NAACP Legal Defense and Education Fund, rose to her defense.

Florida is one of 32 states that is authorized to use the death penalty. "The heinous crime that he committed in our community is the very reason we have the death penalty as an option under the law".

Ayala's position is more in line with a growing national trend by courts, along with some governors and legislatures, that takes a harsher view of the death penalty, Sheppard said in a telephone interview Thursday.

She rejected the idea that automatically taking death off the table eliminates a valuable bargaining chip for prosecutors.

"My duty is to seek justice, which is fairness, objectivity and decency".

"Some victims will support and some will surely oppose my decision, but I have learned that death penalty traps many victim's families in decades long cycle of uncertainty", she said.

Clayton was taken to Orlando Regional Medical Center, but the mother of one, succumbed to her injuries at 7:40 a.m. January 9, Mina reported.

I'm not a big fan of the death penalty.
