Kesha suffers another setback in court battle with Dr Luke

  • A Judge Ruled Against Kesha’s Amended Lawsuit Against Dr. Luke

Furthermore, Kornreich also rejected Kesha's assertions that Dr. Luke breached their original contract, determining instead that Kesha did not perform according to the demands of her contract and didn't give sufficient notice as outlined in her songwriting agreement.

Kesha initially filed to end her contract with the producer in 2015, but her bid fell through in court nearly a year ago (Apr16).

Somehow, the judge also suggested that Kesha should have been aware that working with Dr. Luke would result in the kind of abuse she's alleging. "The same opportunity-to be liberated from the physical, emotional and financial bondage of a destructive relationship-should be available to a recording artist", her claim stated, according to Billboard. The publication notes this is the same judge who denied Kesha's injunction previous year, and who now says that Kesha's the one who's "failed to fulfill her obligations" to Sony.

"It is speculative, not justiciable, whether Sony's contract is ending and whether it will be able to assist after this month", responds the judge.

Here's what's improved and fixed in Windows 10 Mobile build 15061
This is a Microsoft decision, and one that AMD and Intel have no control over, despite what their customers may want. Microsoft's offer of a free upgrade to Windows 10 expired on 29 July 2016, and didn't apply to Vista users anyway.

The countersuit filed in January that the judge struck down alleged that Kesha's creative output while under Dr. Luke's thumb has been severely compromised, claiming that Luke has yet to sign off on her third album, which she is contractually obligated to release on his label.

On claims that Gottwald is withholding royalties from her, the judge says that Sebert has "made no showing that it would have been futile to send an appropriate notice or that she was prevented from doing so". The ruling is another blow to the embattled pop star, who has been trying to get out of her contract with Dr. Luke (real name Lukasz Gottwald) and Sony after claiming the producer sexually assaulted and abused her. This suit has since been thrown out by a New York Supreme Court Judge. "Thus, Kesha may not assert a counterclaim for breach" of law.

"To protect young, newly discovered recording artists from this precise manner of exploitation in quasi-lifetime un-severable professional relationships, California labor law requires all music contracts to end within seven years of execution", Kesha's party argued.
