Pharmacist blamed for meningitis outbreak guilty of racketeering, cleared of murder

But on Wednesday, jurors did not find Cadden directly responsible for those 25 deaths, only the racketeering and fraud charges.

A federal jury in Boston acquitted Barry Cadden, the owner and head pharmacist at the New England Compounding Center (NECC), of second-degree murder charges but convicted him of racketeering, mail fraud, and other crimes in connection with the sale of a contaminated pain medication that caused a deadly USA outbreak of fungal meningitis in 2012.

"As frightful as each of these stories is, there is nothing that shows that Mr. Cadden did something that the government can link to the death of that person", Singal said.

A jury found Barry Cadden, an owner of the now-defunct New England Compounding Center, guilty of some of the charges, but decided against holding him directly responsible for the deaths, which could have resulted in a life sentence for Cadden. In December, NECC's national sales director, Robert Ronzio, pleaded guilty to one count of conspiring to defraud the U.S. Food and Drug Administration.

Cadden, 50, of Wrentham, will be sentenced on June 21. Cadden is out on bail while awaiting sentencing.

"We are very confident that the government is going to be unable to establish that [Evanosky] committed any crime, period", he said. The verdicts were announced this morning in U.S. District Court in Boston.

More than 700 people in 20 states were diagnosed with fungal meningitis and other infections after receiving contaminated medication in 2012.

After expressing his outrage that Cadden was also charged with murder in the deaths of 25 people who took the tainted medicines, attorney Bruce Singal had the audacity to say this.

Cadden's lawyers had conceded that the outbreak was caused by steroids manufactured at NECC, but they said that murder charges weren't warranted, arguing that Cadden didn't act intentionally or know the drugs would kill people, reports the Associated Press.

According to prosecutors, Cadden allowed contaminated drugs to be shipped nationwide.

"Barry Cadden put profits over patients", Weinreb said, The New York Times reported. Some drugs were made by an unlicensed pharmacy technician.
