Uber Technologies Inc. has an alibi for Alphabet Inc.'s allegations of trade-secrets theft - the ride-hailing company's driverless auto technology is completely different from its rival's designs.
Waymo's defense came in the form of a mistaken email with attached blue print of its technology of self driving cars. Waymo doesn't believe them. "Waymo doesn't meet the high bar for an injunction, which would stifle our independent innovation - probably Waymo's goal in the first place", the Telegraph quotes Angela Padilla, Uber's associate general counsel.
Uber's attorneys told the judge that they'd "love" to have Levandowski give his account of the case, according to court transcripts reviewed by Recode.
Otto's founder, Andrew Levandowski is a former Google employee who resigned and was eventually accused of stealing more than 14,000 documents pertaining to the self-driving vehicle technology.

US District Judge William Alsup has said, however, that he will not accept Uber's defence of being unable to find the files as a reason not to grant the injunction. Levandowski's lawyers - not Uber - had attempted to use a broad application of the Fifth amendment in part to to block the report from being included in court, according to the New York Times. At one point Alsup warned he might go as far as to bar Levandowski from working on Uber's program until the litigation is resolved.
Laser-based lidar has emerged as a key technology in the anticipated self-driving vehicle revolution, and in February Waymo had filed a lawsuit accusing Uber and Otto of stealing the ideas behind its "mission-critical" photonic sensors.
"Uber's conduct plainly is created to delay the expedited proceedings ordered by this Court and stonewall Waymo's request for preliminary relief", the court filing reads.
Waymo offered a different take on Tyto's origins in a court filing this week: It said Levandowski secretly formed Tyto in 2014 while he was working for Waymo.
Waymo's injunction motion is a misfire: there is no evidence that any of the 14,000 files in question ever touched Uber's servers, and Waymo's assertion that our multi-lens LIDAR is the same as their single-lens LIDAR is clearly false. "Ultimately, that would be harmful to the public". Uber could argue that as the case is centered on the actions taken by former employees, they should be the ones to get the heat for it.
