Former Milwaukee Officer Found Not Guilty In Shooting Death Of Black Man

Jonathan Smith, one of Heaggan-Brown's defense attorneys, told jurors the former officer didn't have the benefit of seeing the events unfold in slow-motion, which is how prosecutors have shown jurors the shooting using still frames from bodycam footage.

Nearly a year after former police Officer Dominique Heaggan-Brown fatally shot Sylville Smith, a jury found him not guilty of first-degree reckless homicide.

Dominique Heaggan-Brown, who is also black, was one of two uniformed police officers on patrol who stopped two men in a auto.

Defense lawyers for Heaggan-Brown argued that only 1.69 seconds passed from the time Smith was shot in the arm and then shot in the chest.

The death sparked riots on Milwaukee's north side, The Two-Way had reported. Smith had a gun when he ran, but the case hinged on whether he was a threat when Heaggan-Brown fired the shot that killed him.

The second and fatal shot was sacked after Smith tossed his gun and dropped to the ground.

Family members of a black man who was shot to death by a former Milwaukee police officer stormed out of a courtroom after the officer was acquitted in the death.

Milwaukee County District Attorney John Chisholm, who made the decision to charge Heaggan-Brown, said he did not agree with the verdict but would respect it.

Heaggan-Brown was sacked two months after the shooting when he was charged with sexual assault in an unrelated case.

The encounter started as a traffic stop and turned into a foot chase. Jurors are also being given the option to choose from two lesser charges instead — second-degree reckless homicide and homicide by negligent operation of a risky weapon.

When the video is slowed frame-by-frame, Smith is seen holding the gun by the barrel to throw it over the fence. Heaggan-Brown is also black.

News of Dominique Heaggan-Brown's acquittal has sparked plenty of reactions on Twitter. They could have opted for second-degree reckless homicide or homicide by negligent operation of a risky weapon, but jurors acquitted Heaggan-Brown on those charges, too.

"While Smith raises his gun upward, P.O. Heaggan-Brown discharges one shot from his service weapon at Smith and Smith falls to the ground on his back".

The 12 person jury, which included four blacks, sided with the defense. After Smith was shot, the resulting violence during protests left businesses burned, police cars damaged and officers injured. According to Fox6, jurors also had the option to pick from two lesser charges instead of first-degree reckless homicide.

The jury that acquitted Heaggan-Brown consisted of nine women and three men.

But Heaggan-Brown's attorneys say he feared for his safety and had to make a split-second decision.
