US Supreme Court allows Trump's 'Muslim ban' to remain in effect

  • Supreme Court allows Trump administration to continue ban on most refugees

Trump's March 6 executive order said the temporary travel ban and refugee ban would give officials time to assess USA vetting procedures and would address the risk that terrorists could slip into the country.

On Tuesday, the U.S. Supreme Court allowed the administration to maintain its policy on refugees.

The US Supreme Court on Tuesday allowed President Donald Trump to broadly implement a ban on refugees entering the country from around the world. The ruling would have taken effect Tuesday without the high court's intervention. Though several federal courts challenged the ban, in June the Supreme Court partially restored it, allowing the U.S. to bar anyone without "a credible claim of a bona fide relationship with a person or entity in the United States". The order said explicitly that the entry of the refugees was being allowed "pending further order of this court".

The appeals court had also rejected the administration's efforts to bar travel to the United States from six predominantly Muslim countries by people with grandparents, uncles, aunts and other relatives already in the country. A committee of the U.S. court of appeals for the 9th Circuit had elucidated a Supreme Court order this summer to intend that such fugitives should be permitted, but there was an objection from the government.

Justice Department Requests Supreme Court Remove Travel Ban Exception Protecting Certain Refugees
Last week, the lower court narrowed the scope of the travel ban for extended family members such as grandparents and refugees. By that point, the original 90-day travel ban will have lapsed and the 120-day refugee ban will have just a few weeks to run.

The Indiana Court of Appeals agreed in a June ruling that effectively halted lethal executions in Indiana. The appeals court ruled that grandparents and cousins of people already in the USA can't be excluded from the country under the travel ban. The Supreme Court's decision came not long after the Justice Department asked the justices to act. All the 9th Circuit ruling did is "protect vulnerable refugees and the American entities that have been eagerly preparing to welcome them to our shores", the state's lawyers added.

A unanimous three-judge panel of the 9th U.S. Circuit Court of Appeals, sitting in Seattle, agreed on both points. For the moment, it is temporary-Justice Kennedy's ruling does not establish a new precedent, but prevents a Ninth Circuit Court of Appeals ruling that allows more refugees in. The judges made numerous references to Trump's alleged anti-Muslim bias in their respective decisions to block the order.

SCOTUS will take up the travel ban beginning October 10, where they will begin hearings to determine whether the order as a whole is constitutional.

As Prior noted, the final resolution of this case, Trump v. Hawaii, joined to Trump v.
