Judiciary guidelines issued by Department of Justice (DOJ) do not allow the sitting judges of any lower court to hold any press conference or comment to the media.

The four judges viz., Justice Chelameswar, Justice Ranjan Gogoi, Justice Madan Lokur, and Justice Kurian Joseph, who ranked second to fifth in the order of seniority after the Chief Justice of India have alleged that the CJI has not been responsive to their requests despite several attempts to persuade him.

He urged all political parties to refrain from making statements about this issue.

They wrote a letter to the Chief Justice of India about their concerns.

"If they had to come for a press conference, they should have said something substantial", Supreme Court Bar Association President Vikas Singh told ANI on Saturday. It is with no pleasure we come before you but are compelled to do so.

NE region always manages to be in the limelight, this time, for the judge from the NE who is slated to become the next Chief Justice of India.

"All PILs including that demanding probe into Judge Loya death should be taken up by CJI or assigned to courts headed by other four judges of the Collegium", said the resolution. It was supposed to hear the matter on January 23, but the Supreme Court intervened in the matter on Friday and heard a similar petition filed before it, despite objections from lawyers. But the meeting has not yet taken place since Gogoi, Joseph and Lokur have flown out of the capital for other engagements, and are unlikely to return until late Sunday evening.

He said they must have had compelling reasons to go public and "they are not publicity hungry judges and do not crave for unnecessary publicity". The SCBA said this would remedy the issue raised by the senior judges that cases of importance were not being assigned to them.

The government, the letter said, had not responded to the communication and "in view of this silence it must be taken that the MoP has been accepted by the government on the basis of the order of this court". They had on Friday said, "Unless the institution is saved, democracy would be in danger".

Justice Joseph said the judges acted exclusively in the interest of judiciary and justice.

Meanwhile the Bar Council of India Chairan Manan Kumar Mishra has said: "Holding a press conference on a minor issue of roster is saddening". Justice Chelameswar said they wanted to put across their side to the media on the problems of administrative inadequacies in the apex court.

Justice Chelameswar himself described as an "extraordinary event" in the annals of the Indian judiciary when the judges addressed a joint news conference during which he said "sometimes administration of the Supreme Court is not in order and many things which are less than desirable have happened in the last few months".

Some legal luminaries also said the turn of events had raised a question mark about the credibility of the judicial system. It needs to be looked into carefully. Joseph added that the judges had acted only to "enhance the trust of the people in judiciary".

"It is a dark day for democracy that even the judges are working under pressure and without independence", he said. Extreme interference of Central Government with Judiciary is risky for democracy, " she added.
