It marks the first time in modern Division I men's basketball history that a championship has been vacated.

U of L officials said they were surprised and disappointed at the order to vacate records and return NCAA Tournament revenues, and those were the penalties U of L fought.

In its review of the case, the appeals committee found that because of the serious and intentional violations with direct involvement of a university staff member, the Committee on Infractions panel was within its legislated authority to prescribe the vacation of records and financial penalty.

On Tuesday, the governing body announced the appeal has been rejected, according to ESPN. Postel also said he and Interim Athletic Director Vince Tyra felt like the NCAA had its mind made up and never really listened to their argument.

I can not say this strongly enough: We believe the NCAA is simply wrong. During a news conference following the release of the NCAA's decision, Postel said the university hired one of the top lawyers from Georgetown, later named litigator of the year, to make it's case to the NCAA in Atlanta in December.

"This dark cloud has hung over our heads for more than two years, and it has had a negative impact on our athletics program, our fans and the entire university family", Postel said in his statement.

The university's interim president Greg Postel, said at an afternoon press conference that he agrees the conduct that led to the penalties was wrong but that he disagrees with the committee's ruling.

"The violations in the case resulted in some men's basketball student-athletes competing while ineligible", the NCAA explained in its announcement Tuesday, later adding: "The appeals committee stated when student-athletes participate while ineligible, these types of penalties are appropriate".

Louisville coach Rick Pitino, who has denied any knowledge of the 'sex parties, ' was sacked in October in connection with a separate recruitment scandal.

The penalty is the result of an NCAA probe that found that a former Louisville assistant coach had organized "sex parties" for recruits, rendering them ineligible.

Postel asserted, as he said the school did in its appeal, that the program had apologized, cooperated and imposed penalties on itself - actions that "should have been a factor in the severity of the punishment", he said. The team had already self-imposed a postseason ban for the 2016 ACC and NCAA tournaments.

The NCAA Division 1 Infractions Appeals Committee announced its final decision on Tuesday after an unsuccessful appeal by the school. Pitino was placed on unpaid administrative leave and former AD Tom Jurich on paid administrative leave September 27 following the school's involvement in the Federal Bureau of Investigation probe that initially involved the arrests of 10 people.
