Trump claims ex-lawyer’s phone recording ‘perhaps illegal’

  • Totally unheard of & perhaps illegal’ Trump responds to secret lawyer tapes

Trump lawyer Rudy Giuliani told Reuters on Friday Cohen recorded a conversation with Trump in September, two months before the 2016 election, in which they discussed buying the rights to a story by a former Playboy model, Karen McDougal, who said she had an affair with Trump.

"It was already out there so seemed no point in objecting except on principle", Giuliani said.

President Donald Trump on Saturday went on the offensive against his own former personal lawyer after it was reported that Michael Cohen secretly recorded conversations he had with Trump, something the president called "totally unheard of & perhaps illegal".

Yet "it remains murky whether and when a NY lawyer can ethically tape without advance disclosure", Harris said.

The tabloid ultimately did not publish the story, preventing it from becoming public. "Inconceivable that the government would break into a lawyer's office (early in the morning) - nearly unheard of", Trump tweeted Saturday morning. Trump told Cohen to write a check if a payment was to be made, therefore creating a paper trail; and no payment was made in the end, Giuliani said.

Lanny Davis, one of Cohen's lawyers, claimed in a written statement late Friday that the contents of the recording would not be damaging for his client.

President Trumps lawyer Michael Cohen exits the US Federal Court on April 16, 2018, in Lower Manhattan, New York.

The development was first reported Friday by The New York Times.

Trump had apparently been unaware of the recordings until he was told about them earlier this week.

In addition, Giuliani has said there is only one real conversation with the President and the rest are non-substantive, short, more mundane conversations about ministerial matters, like setting up discussions.

Trump's current personal lawyer, Rudy Giuliani, confirmed to the Times that the Cohen tape existed, but said it showed the president had done nothing wrong.

Earlier this year, in an interview with CNN, McDougal detailed what she said was a 10-month affair she had with Trump in 2006 and 2007.

The recording was part of a large collection of documents and electronic records seized by federal authorities from the long-standing associate of Mr Trump earlier this year.

Mr Davis said "any attempt at spin can not change what is on the tape".

McDougal says she began a almost yearlong affair with Trump in 2006, shortly after Trump's wife, Melania, gave birth to their son Barron. "In the big scheme of things, it's powerful exculpatory evidence".

Trump is largely silent in the conversation, the people said, neither expressing surprise nor indicating whether he knew previously about the AMI deal.

In May, President Trump admitted that he had reimbursed Mr Cohen for a payment he made to another woman to hush up her claims of an affair.

The FBI is also investigating Cohen's payment of $130,000 to adult film star Stormy Daniels in the weeks leading up to the election in exchange for silence about an alleged one-time encounter with Trump.

Mr. Cohen, an attorney, received a monthly retainer, not from the campaign and having nothing to do with the campaign, from which he entered into, through reimbursement, a private contract between two parties, known as a non-disclosure agreement, or NDA.
