The conflict arose after Mr. Booker probed Judge Kavanaugh Wednesday night over his thoughts on race in America - and demanded he explain 2002 emails where he said the Supreme Court nominee discussed racial profiling.

Here's why he did so - and what's likely to happen as a result.

The hearings are expected to continue on Friday with testimony from outside witnesses presented by committee Republicans and Democrats.

A long day of questioning awaits the 53-year-old appellate judge, whom Trump nominated in July to fill the seat of retired Justice Anthony Kennedy.

Judiciary Chairman Chuck Grassley, R-Iowa, objected to Booker's use of the word sham. "And he'll keep releasing them because Republicans are hiding Brett Kavanaugh's record from the American people".

Some documents have been withheld altogether.

A number of Democrats on the committee then stepped forward to say they would also share any consequences suffered by Booker for releasing Kavanaugh's emails.

In previous writings, Kavanaugh has advocated more latitude within the executive branch. And when he asked if Harris had a specific person in mind that he may have talked to, she replied, "I think you're thinking of someone and you don't want to tell us".

"It's inappropriate to raise these in an open session before the committee", replied Sen. "Let's go through that process because I think the public should understand that at a moment someone is up for a lifetime appointment.I hope they'll follow through".

"The public has a right to access documents about a Supreme Court nominee's views on issues that are profoundly important, such as race and the law", he continued. "All of us are ready to face that rule on the bogus designation of committee confidential", said Sen.

Much of this is political melodrama, certainly. These senators are showing the sort of courage as well as the genuine moral compass we wish politicians exhibited all the time. Those were for more traditional offenses: fraud, corruption, abuse of power. Klobuchar, wearing a blue jacket and top, publicly supported Booker during his act of civil disobedience on Thursday, saying that the hearing was "ramrodded through" for "political reasons".

The Senate could, however, move to impose a less severe form of punishment known as "censure". Democratic Sens. Booker, Kamala Harris of California and Amy Klobuchar of Minnesota, all widely considered to be potential presidential contenders in 2020, have each used their time in the highly publicized hearings to maximum effect to lay groundwork for a potential campaign.
